Terms of Service

These Terms of Service ("Terms") govern your use of elitefinishesga.com (the "Site") and the painting, finishing, and related services ("Services") offered by Elite Finishes GA ("Elite Finishes," "we," "us," or "our"). By using the Site or engaging us for Services, you agree to these Terms.

1. About Elite Finishes

Elite Finishes is a residential and commercial painting company based in Alpharetta, Georgia, serving the surrounding North Fulton communities. Specific Services, scope of work, pricing, and timelines are set out in a written estimate or contract provided to you separately.

2. Use of the Site

You may use the Site for lawful, personal, and non-commercial purposes. You agree not to:

• Use the Site in any way that violates applicable laws or regulations
• Attempt to interfere with the Site's operation, security, or other users
• Reverse engineer, scrape, or extract data from the Site without our written permission
• Upload or transmit viruses, malicious code, or harmful content
• Submit false, misleading, or fraudulent information through any forms

3. Quote Requests and Estimates

Information you submit through our quote request form, photo upload, or other intake tools is used to prepare an estimate and contact you. Estimates are non-binding until both parties sign a written contract or otherwise expressly agree. Pricing displayed in any calculator or visualizer on the Site is an approximation for guidance only — your final estimate may differ based on site conditions, scope, and material selections.

4. Services Agreement

All Services are governed by the written estimate, statement of work, or contract you sign with Elite Finishes. In the event of any conflict between these Terms and a signed Services agreement, the signed agreement controls for that engagement.

5. Payment

Payment terms (deposit amount, milestone payments, balance due on completion) are set out in your written estimate or contract. Late payments may accrue interest at the maximum rate permitted by Georgia law and may delay scheduling of additional work.

6. Guarantees

Elite Finishes offers the following guarantees, subject to the terms in your signed Services agreement:

• 6-Month Interior Touch-Up Guarantee on residential interior work
• 7-Year Exterior Labor & Material Guarantee on residential exterior work

Guarantees do not cover damage caused by normal wear and tear, structural movement, water intrusion, fire, vandalism, modifications by other parties, or surfaces we did not prepare. Specific exclusions are detailed in your signed agreement.

7. Intellectual Property

All content on the Site — including text, photography, logos, graphics, and design — is owned by or licensed to Elite Finishes and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent, except that you may share project photos we feature on social media with attribution.

If you submit photos, testimonials, or other content to us (for example, by uploading a project photo or leaving a review), you grant Elite Finishes a non-exclusive, worldwide, royalty-free license to use, display, and reproduce that content for our marketing and business purposes. You represent that you have the right to grant this license.

8. Disclaimer of Warranties

The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Any warranty applicable to our Services is set out in your signed agreement, not in these Terms.

9. Limitation of Liability

To the fullest extent permitted by law, Elite Finishes is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, including loss of data, profits, or business. Our total liability arising from your use of the Site is limited to one hundred U.S. dollars ($100). Liability in connection with Services is governed by your signed agreement.

10. Indemnification

You agree to defend, indemnify, and hold harmless Elite Finishes and its owners, employees, and contractors from any claims, damages, costs, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site, violation of these Terms, or violation of any third-party rights.

11. Third-Party Links and Services

The Site may link to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of those third parties. Your interactions with third-party services are subject to their own terms and policies.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Fulton County, Georgia, and you consent to the exclusive jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the current version. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
